1. Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “Learner”, “Creator”, or “Supporter”) and Mubu Manayath (Operating as Tieque) (“Tieque”, “we”, “us”, or “our”). If you do not agree to all provisions of these Terms, you must immediately discontinue use of the platform.

2. Eligibility and Account Registration

You must be at least 13 years of age to create an account on Tieque. If you are under 18 years of age, you represent that you have obtained consent from a parent or legal guardian. You agree to provide accurate, current, and complete information during registration and to keep your credentials confidential. You are solely responsible for all activities occurring under your account.

3. User Responsibilities & Conduct

Learners agree to use the platform exclusively for lawful educational purposes. You agree not to: (a) engage in academic dishonesty or cheating on quizzes or exams; (b) share account credentials; (c) attempt to reverse-engineer, scrape, or extract platform code, databases, or content; (d) introduce malware or flood APIs; or (e) transmit defamatory, infringing, or harmful material.

4. Public and Third-Party Learning Content

Tieque curates links to publicly available educational videos hosted on third-party platforms, primarily YouTube.

• Intellectual Property: All third-party videos remain the exclusive property of their respective creators and copyright owners.
• Player Embedding: Videos are embedded using official YouTube embedded players (youtube-nocookie.com) in compliance with YouTube Terms of Service.
• No Ownership Claim: Tieque does not produce, own, or claim exclusive rights to external video materials. We provide an educational indexing, sequencing, and progress-tracking service.

5. User-Created Courses and YouTube Links

Authenticated users may organize public YouTube playlists into structured creator courses. By submitting YouTube links, you represent that: (a) the content is publicly accessible; (b) your playlist does not infringe upon any third-party copyright, trademark, or privacy rights; (c) the content complies with YouTube Community Guidelines; and (d) the content does not contain hate speech, pornography, or violence. Tieque reserves the right to unpublish, edit, or remove any creator course violating our standards.

6. Free and Paid Services

Tieque distinguishes clearly between free and paid educational offerings:

• Free Services: Browsing course catalogs, watching lesson videos, and tracking personal lesson progress is completely free for all registered users.
• Optional Paid Services: Taking final examinations for certified credentials, claiming official certificates, participating in fee-based prize contests, voluntary educational sponsorships, and voluntary coffee contributions.

7. Pricing, Payments, and Taxes

All prices are quoted in Indian Rupees (INR, ₹) and include all applicable taxes unless expressly stated otherwise. Payments are processed securely via authorized Indian payment gateways (such as UPI, Netbanking, Cards, or Tieque Wallet balance). Prior to completing any payment, the exact final payable amount, service description, and refund conditions are displayed.

8. Assignments, Assessments, and Examinations

Certain courses offer end-of-level quizzes and final comprehensive examinations. Where an examination fee is applicable, payment must be completed prior to unlocking the exam questionnaire. Once an examination has started, the examination fee becomes non-refundable, as detailed in our Refund Policy.

9. Certification Eligibility and Issuance

Certificates of completion are issued to learners who have completed all required lesson modules and achieved the minimum passing grade on the final assessment.

10. Educational Sponsorships & Platform Support

Users may voluntarily contribute to our “Sponsor a Village Student” programme or our “Buy Me a Coffee” fund.

• Segregated Funds: Educational sponsorships are restricted to funding student course licenses and rural educational access. Platform support funds operating and server costs. The two funds are never commingled.
• Tax Status Notice: Voluntary contributions to Tieque are NOT tax-deductible or charitable donations under Section 80G of the Indian Income Tax Act.

11. Intellectual Property & Copyright Infringement (DMCA / Indian Copyright Act)

Tieque respects the intellectual property of others. If you believe your copyrighted material is displayed or linked on Tieque without authorization, please submit a written takedown notice to support@tieque.in with identification of the copyrighted work and its specific URL on our platform. We investigate and resolve copyright notices promptly.

12. Refund and Cancellation Rules

Our refund rules vary by transaction type and are governed strictly by our dedicated Refund and Cancellation Policy. Verified technical errors, duplicate debits, and unauthorized charges will be promptly investigated and refunded in accordance with applicable payment gateway rules.

13. Privacy and Personal Data

Your privacy is paramount. Please review our Privacy Policy, which governs our collection, storage, and processing of your personal information, cookies, and payment transaction logs.

14. Platform Availability and Disclaimer of Warranties

Tieque is provided on an “as is” and “as available” basis. We do not warrant that platform operations will be uninterrupted, error-free, or free from viruses. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

15. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Tieque, its operators, officers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our total aggregate liability for any claim arising under these Terms shall not exceed the amount actually paid by you to Tieque in the preceding three (3) months.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Kerala, India.
